Christmas Message

One whole year!

I would like to wish everyone a Merry Christmas and a Happy New Year, in particular my fellow nationalists!

As ever, I have always warned that I will only update this blog concerning internal legal wranglings within the BNP when I absolutely have to.

The defendants have made a number of allegations which are mostly false and are taking advantage of the fact that in a legal battle for us to beat them, we cannot get into a public bun fight with them concerning all of the allegations we make against them.

I warn everyone reading this blog, to understand that Adam  Walker & Clive Jefferson are packing out editions of the British Nationalist bulletin which is sent out to members in the post, with lies from front cover to back.

The claim has NOT been tested in a full trial and therefore, the defendants have not been “cleared” or “vindicated” of anything, but to be fair, nothing has been proven or settled – yet.

I am sorry to report that we’ve had a setback, but this setback is borne out of  legal procedure rather than the actual merits of the cause of the claim.

We are in the process of changing our legal team and I expect this to go on for some time.

Until my new legal team is up to speed, I cannot comment on the details.

Given all the evidence that we have, we cannot and will not ever let go of this, because if we did, we would be unable to look at ourselves in the mirror each morning.

With wrong-doing as blatant and on the scale the defendants have committed, given that the defendants are up against long standing members who’ve uncovered it all, it is only a matter of time before Adam Walker and Clive Jefferson are brought to justice.

They continue to ride coaches and horses through the BNP constitution just so that they can wind the party down and have a quiet life.

The so called GMM (General Members Meeting) to make yet more changes to the constitution for the benefit of Adam Walker, will be eventually challenged. Coronavirus cannot be used as an excuse to have a GMM behind closed doors with just 6 people to vote through changes to the protected parts of the constitution, when the membership has been excluded from debate. 

Adam Walker & Clive Jefferson aren’t interested in real serious political campaign work at this time.

We, the activists, are interested in political campaigning.  

There are more of us more than them and no matter how much money Adam Walker and Clive Jefferson defraud from the party, between all of us, we will always build up and have more resources than them.

We will eventually prevail, we aren’t going anywhere. Behind the scenes, we are building our own resources to continue this fight.

I cannot stress how important it is that every BNP member renews their membership. One day, we are likely to force the membership to vote in an EGM and of course, you won’t be able to vote if you’re not a member!

Concerning morale, it’s easy to be disheartened by all of this, however, I’m very upbeat on the future of the BNP, nationalism and populism in the UK.

If we cast our minds back, the advent of the internet gave us all a voice.

Without the internet and social networking, Brexit would have not happened.

I look forward to exciting technological progress that will allow us to organise in robust and secure ways, that will be hard for the enemies of democracy and fairness to disrupt.

Update re December 3rd hearing.

As promised an update. 

On Tuesday 3rd December, we were in front of Master Hill QC. The defence had put in a number of applications, one at the last minute. 

Master HIll QC has directed the case and all of its applications to be heard in front a Queen’s Bench Judge.

I am happy with the direction that Master Hill QC has given, especially considering that our next hearing could have easily wound up in front of another master. It’s better that a judge hears it sooner rather than later so that we can get justice and move on.

Sorry to sound like a broken record. December is membership renewal month for a lot of members and I remind everyone to renew their memberships.

Legal Proceedings – November 2019 update

My apologies for not posting updates for a while, but my primary focus is on the legal battle and ensuring nothing compromises it.

There was a hearing at the High Court (Queen’s Bench Division) on October 22nd 2019 in front of a High Court Master.

Mr Walker and Mr Jefferson made an appearance. I attended, along with 3 party members who were invited to witness the proceedings.

That hearing was scheduled for a duration of two hours and it was not enough time to resolve the case, however some progress was made on legal procedure and so we’re all set for a hearing in late November in front of another High Court Master. Half a day is allocated for this upcoming hearing.

While I am hopeful that the case can be resolved in the upcoming hearing in late November, there are a number of things that can happen, including the case being further adjourned so that it is tested in front of a High Court judge at a later date.

As I have already stressed in my previous posts, whatever the outcome of any legal hearing or battle, no matter what, it is paramount that BNP members renew their membership to retain voting rights.

Furthermore, if you are not a current member of the BNP, the sooner you join or rejoin, the sooner you will have voting rights within the party.

I will post another update by close of business December 6th, which is a Friday.

Legal action continues against Walker, Jefferson & Co.

Negotiations  with the defendants were unsuccessful and I have instructed Tilbrook’s to continue with proceedings against them.

Defendants have been served

A claim against the defendants has been lodged with the High Court in London.
The claim for, details of the claim, response pack and bundle of exhibits (evidence) has been served to the defendants.
I urge members to ensure their memberships are up to date, as non-members do not get a say, nor can they vote in general members meetings.
Members should continue their normal regular activities.  Do not treat this as bad news, it’s actually good news and the party has a great future ahead of it.

See you in court Adam Walker – Democracy is coming back to the BNP

My solicitor has been instructed to go ahead with legal action against a number of defendants including Chairman Adam Walker and party treasurer Clive Jefferson.

In the background, away from the public domain, a two year process of trying to hold the leadership of the BNP to account, of trying to get Chairman Adam Walker to do the most basic thing – uphold the BNP Constitution, has been exhausted.

IN FACT, THE BNP CONSTITUTION HAS HAD PROTECTED PARTS CHANGED COVERTLY, BEHIND THE MEMBERS BACKS, WITHOUT VOTING MEMBERS BEING GIVEN A VOTE AS THE CONSTITUTION MANDATES.

SUCH INVALID AND ILLEGAL CHANGES BENEFITED THE TREASURER AT THE EXPENSE OF THE NEC.

I am forced to bring legal action against Adam Walker, Clive Jefferson and other defendants, who have collectivity failed to reply in a satisfactory manner to “Pre-action before claim” letters sent to them by my solicitor. They have also failed to reply to follow up reminder letters.

The defendants failure to treat the matter seriously only strengthens the case against them.

That failure also gives me the green light to take the defendants to court, we are past the point of no return. A date in court is unavoidable and I will be working with my solicitor to ensure that happens ASAP.

It has come to light, that not only have the defendants failed to uphold the BNP Constitution, they have actually broken it by covertly changing the BNP Constitution, refusing to acknowledge that it’s been broken and furthermore, are ignoring any proposed remedies to fix it.

Before I go into the details of the legal action and why it’s being brought, I urge all members to renew their membership of the party and not feel downhearted and demoralized in any way. It is vital that you do, because if you don’t, you will not have any say in the future of the party and you would be dropping your democratic right to vote in future BNP leadership elections, policy motions, votes of confidence and constitution changes. 

A lot of money is being spent on legal proceedings to force an EGM.

If and when that EGM happens, members need to turn up to it and vote for what they want, hopefully after a fair hearing from any voting member who wishes to speak.

Many members who know me, know that I’ve always worked hard to keep internal party matters out of the public domain. However because of the nature of the legal action and why it’s being brought, it’s vital that I go public now.

If you are one of our friends, perhaps an ex member or someone thinking of joining our party, I urge you to join, because I believe strongly that the party has a future.

I’m proud of the activists and members that we have, as they are wise people who understand that our party’s future depends not on the resolve of its present or future leadership, but on the resolve of the membership, activists and officials to stop at nothing to ensure that The Constitution is upheld and enhanced so that we can build a strong and well structured party.

Far from feeling demoralized, I’m actually quite excited for the future of our party.

This isn’t some squalid dodgy dossier that’s somehow supposed to discredit people. It’s vital information that BNP members need.

If and when Chairman Adam Walker and Treasurer/Dept Chairman Clive Jefferson finally face the members, you will have questions that you will be able to ask them.

My trust in Adam Walker and Clive Jefferson has long broken down, as they have deployed tactics that has destroyed my confidence that they will play ball fairly and respect the rights of members and officials.

They have so far been evasive and ignored my questions so far. I have tried the NEC route as per the constitution, emails, phone calls and letters via my solicitor. As I have said, two years have gone by, this hasn’t come about because of a personal fall out. I have worked very hard to keep personality politics out of it.

I urge all members to simply digest the information I post on this website. You should share it privately. Please don’t share it on the public domain. Your Facebook wall is NOT private, please don’t share it that way.

I urge members to refrain from any attempt at public discussion of these revelations. Others will try to get you to make public comment, it’s vital that you resist the temptation no matter what is being said by those outside (or even inside) the party. If you find a party member commenting on public forums, the best thing to do is contact privately and urge them to stop.

Chairman Adam Walker and others at party HQ may very well release statements concerning all of this. Again in such circumstances I advise party members to refrain from commenting in the public domain. If you really have to comment, it’s your right to do so, but I would keep in mind the BNP’s code of conduct before doing so. It would be an awful shame if you got yourself expelled, as fun as it would be to ask which BNP Constitution you are being expelled under!

At the bottom of this article are links to the legal documents that have been served to the defendants. Please read through them carefully and you will be fairly up to speed as to why the legal action is being brought about.

Not everything is explained in those legal documents, but most of it is.

Before you read those documents, you should understand that the BNP Constitution has been covertly changed so that bank / building society accounts could be opened up by BNP treasurer Clive Jefferson even though the legitimate BNP Constitution expressly forbids it.

This is quite concerning considering who the co-signatory is on those accounts – Valerie Donahue. A lady who is quite close to Clive Jefferson considering that she took him in at the age of 15 when his natural Mother passed away.

It’s impossible for Clive Jefferson to claim he had no knowledge of The Constitution being covertly changed, taking away powers from the NEC and Head of Administration, when he has taken advantage of such fraudulent changes by opening up building society accounts, that the older legit constitution forbade him from doing.

Please note, that I’m not just talking about what pages and documents exist on the WayBackMachine for the BNP website, we’re also talking about the BNP Constitution that was filed By Adam and Clive with the Electoral Commission when they failed to renew the party’s registration in early 2016.

Concerning the Electoral Commission. It should be noted that upon renewing their registration , political parties are not supposed to file their constitutions even if there is updates in their constitutions, unless the changes that were made make a material difference to anything that was written in their financial schedule when they first registered with the Electoral Commission. In plain English, it’s only under special circumstances that the Treasurer of a political party should file updated constitutions.

At least one major change was made to the protected part of The BNP Constitution and as such, as per The Constitution, changes to the protected part of the constitution demands that the major revision number is incremented and not the minor AND that a vote of voting members is held, amongst other things.

The constitution was changed behind members backs, covertly. 

In a fantasy alternate reality, had the voting membership been mad enough to pile into an appropriate meeting and vote to strip the NEC of such a vital power in favour of our treasurer Clive Jefferson, then the next valid BNP Constitution would have been numbered 15.1 rather than 14.x to draw attention to such a major change.

It wasn’t, because it was covertly done as so not to draw attention. They jumped from the legitimate 14.2 to the illegal 14.4 –

To summarize, the legal action being taken out against the defendants, has a number of aims:

  • The correct BNP Constitution is published on the party website.
  • The Cumberland building society accounts are shut down.
  • The Constitution is upheld – 4 NEC meetings are held a year along with an AGM / Conference.
  • The Constitution is freed up so that NEC members from the regions can be elected when the next leadership election is called.
  • To ensure that future leadership elections are fair.
  • Remove conflicts of interest that Clive Jefferson has.
  • Make the Chairman accountable to the NEC again.

Invalid Changes to the BNP Constitution

OLDER (LEGIT) CONSTITUTION Rev. 14.2 Section 8.16 

8.16 The Chairman shall appoint a National Treasurer, who shall sit as of right on the National Executive for as long as he or she holds this position. The National Treasurer shall administer the central funds of our Party, and shall be  required  to  provide  to  the  Chairman  and  Deputy  Chairman,  regular accounts  of  all  items  of  income  and  expenditure. All  cheques  issued  shall bear the signatures of the Head of Administration and one person chosen by simple majority vote of the National Executive. For the avoidance of doubt, the  National  Treasurer  shall  not  be  a  signatory  to  any  Central  Party accounts. In the event of an equality of votes, the National Treasurer shall have the casting vote. The Party Treasurer shall not make payments in any form, including via electronic banking systems.

NEWER (ILLEGAL) CONSTITUTION Rev. 14.4 Section 8.16 

8.16 The Chairman shall appoint a National Treasurer, who shall sit as of right on the National Executive for as long as he or she holds this position. The National Treasurer shall administer the central funds of our Party, and shall be  required  to  provide  to  the  Chairman  and  Deputy  Chairman,  regular accounts  of  all  items  of  income  and  expenditure. All  cheques issued  shall bear  the  signature of  the National  Treasurer  or  someone  delegated  in writing  by  him and, if  need  be or  deemed  desirable  by  the  Chairman,one person,chosen by him/her and notified in writing to the National Treasurer. In  the case  of a  second signatory  the  Chairman  may  remove  him/her from any  account  in  writing  at  his  sole  discretion. All  electronic  banking transactions conducted in connection with central funds must be authorized in  writing  by  the  National  Treasurer.All  transactions  over  £100  must  be authorized   in   writing   by   the   National   Treasurer.   This   Constitution authorizes the National Treasurer to set up trading names for the Party and allows  him  to  establish  bank  accounts  in  those  names with  the  written approval of the Chairman. Trading names currently authorized by the Party are: British Heritage, Freedom Promotions and The Trafalgar Club.
